If you submit or upload content to the Site ("User Content"), you grant Valstad a non‑exclusive, worldwide, royalty‑free, sublicensable license to use, reproduce, modify, and display such User Content in connection with the Site. You represent that you have all rights necessary to grant this license and that your User Content does not violate any third‑party rights or laws.

6. Prohibited Conduct

You agree not to:

• Use the Site for any unlawful purpose;
  
• Interfere with or disrupt the Site or servers/networks connected to the Site;
  
• Attempt to gain unauthorized access to any portion of the Site or any other accounts, computer systems, or networks;

The Site is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non‑infringement, and course of performance. We do not warrant that the Site will be uninterrupted, secure, or error‑free.

9. Limitation of Liability

To the fullest extent permitted by law, Valstad, its affiliates, and their respective directors, officers, employees, or agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site.

10. Indemnification

You agree to indemnify and hold harmless Valstad and its affiliates, directors, officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or violation of these Terms.

11. Governing Law & Venue

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of such courts.

12. Dispute Resolution

Before initiating any formal dispute, you agree to first contact us at hello@valstad.com to attempt to resolve the issue informally. If we cannot resolve the dispute within 60 days, either party may pursue relief in court consistent with Section 11.

13. Termination

We may terminate or suspend your access to the Site at any time, without prior notice or liability, for any reason, including if you breach these Terms.

14. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and Valstad regarding your use of the Site.
  
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
  
• Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
